Definitions
- “App” refers to Comfy Portal mobile application
- “ComfyUI” refers to the open-source AI image generation framework, which is a separate project not affiliated with us
- “Server” refers to any ComfyUI server instance that you connect to
- “Content” refers to any images, prompts, workflows, or other materials generated or processed through the App
- “We”, “us”, “our” refers to the App developers
- “You”, “your” refers to the user of the App
1. Acceptance of Terms
By downloading, installing, or using Comfy Portal (“the App”), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services. The App is intended for users 17 years of age or older.
This agreement is between you and the App developers only, and not with Apple or the ComfyUI project. We, not Apple or ComfyUI, are solely responsible for the App and its content.
2. Description of Service
Comfy Portal is an independent mobile client application that provides an interface to connect to and interact with ComfyUI servers. The App:
- Is a third-party client and is not officially affiliated with the ComfyUI project
- Allows you to connect to self-hosted or third-party ComfyUI servers
- Provides tools for managing and running AI image generation workflows
- Stores all data locally on your device
- Does not provide any AI models or processing capabilities itself
- Does not modify or redistribute ComfyUI’s source code
Relationship with ComfyUI
- We are an independent third-party client for ComfyUI
- We are not affiliated with, endorsed by, or officially connected to the ComfyUI project
- ComfyUI is an open-source project with its own terms and licenses
- ComfyUI is licensed under the GNU General Public License v3 (GPLv3)
- All rights to ComfyUI belong to their respective owners
- We do not claim any ownership or rights over ComfyUI or its components
- We do not modify, distribute, or include any ComfyUI source code in our App
- Our App only communicates with ComfyUI servers through network APIs
- Users are responsible for:
- Complying with ComfyUI’s license terms when using their software
- Ensuring they have the right to use and operate ComfyUI servers
- Understanding and following the terms of the GPLv3 license for their ComfyUI installation
Notifications
- We may send you App-related notices, announcements, and updates through:
- In-App notifications
- Email communications
- App Store updates
- By using the App, you consent to receive such communications from us
- Critical updates about security or terms changes will be sent via email
3. License Scope
The license granted is:
- Non-transferable
- For personal use on Apple-branded devices that you own or control
- Subject to the Usage Rules in the Apple Media Services Terms and Conditions
- Accessible by other accounts via Family Sharing if applicable
4. User Responsibilities
You are responsible for:
Server Management
- Maintaining the security of your ComfyUI servers
- Ensuring you have the right to use and access the servers you connect to
- Understanding and complying with the terms of service of any third-party servers you use
Content and Usage
- All content you generate or process through connected servers
- Ensuring you have the right to use any images, prompts, or other content you process
- Using the App in compliance with all applicable laws and regulations
- Not using the App for any illegal or unauthorized purposes
Data Management
- Backing up your data regularly, including workflows and settings
- Managing your device’s storage space
- Securing your local data and server connection information
- Understanding that we cannot recover your local data if lost
Network Usage
- All data charges and fees from your mobile carrier or internet service provider
- Ensuring stable network connectivity for server communications
- Any costs associated with running or connecting to ComfyUI servers
Security
- Maintaining the security of your device and app data
- Protecting your server connection information
- Reporting any security vulnerabilities you discover
5. Age Restrictions and Content
- The App is rated 17+ and intended for mature users only
- Users must be at least 17 years old to use the App
- Users are responsible for:
- Any mature content they may generate through AI models
- Complying with local regulations regarding AI content generation
- Using AI generation tools responsibly and ethically
6. AI Content Generation
Users must understand and agree that:
- AI generated content may be subject to certain rights or restrictions
- You are responsible for:
- Reviewing and moderating all AI generated content
- Ensuring generated content complies with applicable laws
- Any consequences of using or sharing AI generated content
- Understanding and respecting intellectual property rights
- We do not monitor or control the content you generate
- You should not generate content that is:
- Illegal or promotes illegal activities
- Harmful, discriminatory, or offensive
- Violating others’ intellectual property rights
- Intended to harass or harm others
7. Maintenance and Support
- We are solely responsible for providing maintenance and support for the App
- Apple has no obligation to provide any maintenance or support services
- Support requests and questions should be directed to our support email
- We will provide support in accordance with our stated support policies
8. Third-Party Services
Server Connections
- The App connects to ComfyUI servers that you configure
- We are not responsible for:
- The availability or performance of these servers
- The privacy practices of third-party servers
- Any data processed or stored by these servers
- Content generated through these servers
Other Services
- The App may use our web services for displaying documentation
- System-level services (like crash reporting) are handled by your device’s operating system
- You must comply with applicable third-party terms when using the App
9. Intellectual Property
- The App and its original content are protected by copyright and other intellectual property laws
- You retain all rights to content you generate through the App
- You are responsible for ensuring you have the rights to any content you process
- The App does not claim ownership of any content you generate or process
- In case of any third-party intellectual property claims, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim
10. Warranty and Refunds
The App is provided “as is” without warranties of any kind, either express or implied, including but not limited to:
- Server connection reliability
- Content generation results
- Compatibility with specific ComfyUI versions
- Suitability for your specific needs
In the event of any failure of the App to conform to any applicable warranty:
- You may notify Apple, and Apple will refund the purchase price of the App
- To the maximum extent permitted by law, Apple will have no other warranty obligation
- Any other claims, losses, liabilities, damages, costs, or expenses will be our sole responsibility
11. Product Claims
We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including but not limited to:
- Product liability claims
- Any claim that the App fails to conform to legal or regulatory requirements
- Claims arising under consumer protection, privacy, or similar legislation
- Claims in connection with the use of the HealthKit and HomeKit frameworks
12. Legal Compliance
You represent and warrant that:
- You are not located in a country subject to a U.S. Government embargo
- You are not listed on any U.S. Government list of prohibited or restricted parties
- You will comply with all applicable third-party terms of agreement when using the App
13. Limitation of Liability
We shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of data or content
- Server connection issues
- Results of AI generation
- Actions of third-party servers
- Content generated through connected servers
- Data usage or carrier charges
- Loss of local data or settings
14. Subscriptions and Payments
Subscription Terms
- Subscription features and pricing will be clearly indicated in the App
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Payment will be charged to your Apple ID account at confirmation of purchase
- Your account will be charged for renewal within 24 hours prior to the end of the current period
Subscription Management
- You can manage and cancel your subscription through your Apple ID account settings
- Cancellation will take effect at the end of the current subscription period
- No refunds will be provided for the unused portion of the current subscription period
- Any unused portion of a free trial period will be forfeited when purchasing a subscription
Price Changes
- We reserve the right to change subscription prices
- Price changes will be notified to users in advance
- Price changes will take effect at the next subscription renewal
- You will have the opportunity to review and accept the new price, or cancel your subscription
15. Termination
Our Termination Rights
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason including, but not limited to:
- Violation of these Terms
- Suspected illegal, fraudulent, or abusive activity
- Upon request by law enforcement or government agencies
- Technical or security issues
Effects of Termination
Upon termination:
- Your right to use the App will immediately cease
- You are responsible for backing up your local data
- You may lose access to any subscription features
- Certain provisions of these Terms will continue to remain in effect
Surviving Provisions
The following sections survive termination:
- Intellectual Property
- Limitation of Liability
- Governing Law
- Any other provisions meant to survive termination
16. Modifications to Service
We reserve the right to:
- Modify or discontinue the App at any time
- Update these terms of service
- Require you to accept updated terms to continue using the App
- Change the pricing of any paid features with appropriate notice
17. Third Party Beneficiary
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid:
- Such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law
- The remaining provisions will continue in full force and effect
- The invalid or unenforceable portion will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision
19. Entire Agreement
These Terms constitute the entire agreement between you and us regarding your use of the App, and supersede and replace any prior agreements we might have had between us regarding the App. No waiver of any part of these Terms will be deemed a further or continuing waiver of such term or any other term.
20. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developers operate, without regard to its conflict of law provisions.
